The whole Barisan Nasional (BN) government is clearly jittery and sometimes its leaders cannot get things right.

COMMENT

The events in the next few days would give us an idea as to how the police would treat the "yellow Malaysians" who would gather for the indoor rally.

It's now confirmed that the Bersih 2.0 rally, which calls for free and fair elections, would be held at a stadium. But the rally organisers have their demands – to hold the rally at Stadium Merdeka, set up a Royal Commission of Inquiry (RCI) on the electoral process and release all detainees, including those arrested under the Emergency Ordinance (EO)

But yellow T-shirts are still deemed illegal and Bersih stays an unlawful organisation. How would Prime Minister Najib Tun Razak negotiate with an unlawful organisation? Beats me.

Sometimes, government leaders cannot get it right. In Malaysia, we have been seeing this over the last two weeks.

Najib and Home Minister Hishammuddin Hussein plus the whole Barisan Nasional (BN) government are clearly jittery.

Thanks to the inefficiency of the government, we are moving backwards as a nation. Clamping down on legitimate dissent, jailing activists, nabbing people for wearing yellow T-shirts, getting panicky over street protests – these are not the marks of a progressive nation.

All the weaknesses of BN's shoddy administration which gave the opposition its historic win in 2008 are also present as I write this – discontent among the urban and rural folks, soaring prices, repression of democratic rights, arbitrary arrests… the list could go on.

But instead of looking into issues that affect Malaysians, the government is again using its police goons and manipulating the law to repress people.

Guessing game

I am playing a guessing game here – the other possible developments in the next few days could include the Malaysian Communications and Multimedia Commission (MCMC) suspending or closing down blogs; Internet-based papers being jammed as what happened during the Sarawak election and your faithful mobile phone operators doing a number on their clients.

I am yet to exhaust my list.

One has to only read the headline news yesterday to play my guessing game. The whole "weapons being found ahead of rally" drama is plain stupid. I would think the police would have better brains – didn't we all see the Molotov cocktails? The bottles were so clean and the "parring" glittering.

If the police do not stop barging in on private meetings held by Bersih 2.0 organisers and eyeing everyone with suspicion, we could conclude they would flex their muscles come Saturday. So no yellow T-shirts, shoes, ties, hair bands, plastic flowers.

This morning – despite Bersih agreeing to move its rally to a stadium – the police erected roadblocks along major roads in the Klang Valley including Shah Alam and Klang, causing massive peak-hour traffic congestions. I understand three more people were arrested this morning for wearing the yellow Bersih T-shirts.

All signs point to a major clampdown in the next few days.

We know that domestic politics has a strong impact on foreign investment. The latest report by Global Investment Trend Monitor, a publication of the United Nations Conference on Trade and Development, shows the 2010 FDI figure for Malaysia at US$ 7 billion (RM21 billion).

In comparison, Indonesia received US$12.8 billion while Hong Kong and Singapore's FDI stands at US$62.6 billion and US$37.4 billion respectively. Thailand, with its political upheaval, received US$6.8 billion.

Clearly someone has to tell the government that it needs to buck up for the revival of the economy.

There must be a clear injection of accountability into the administration for investors to come. Using the police to do its dirty work, back-door deals to stem healthy dissent, a complete disregard for the law and suppression of democratic rights are an overkill.

Besides this, allowing belligerent politicians to play the racial card would only see to the continued nose-diving of foreign investment in the country. The very fact that some politicians use the racial bogeyman to create chaos, knowing it would lead to people harming each other on the streets, shows the failure of the government to instill racial harmony in the real sense.

The victory clinched by the Bersih 2.0 rally organisers demonstrates people's power. The government has to respect the aspirations of the people. Or it would become even more irrelevant than before.

【本刊记者撰述】警方连续逮捕有关净选盟者引起联合国人权事务高级专员办公室（ OHCHR ）关注，该机构呼吁马来西亚政府释放所有有关人士，并废除紧急法令等防范性逮捕法令，以示尊重表达自由。

联合国人权事务高级专员发言人科尔维尔（Rupert Colville）今天发表文告说，联合国人权委员会近期接获报告，指马来西亚政府针对净选盟成员采取骚扰、恐吓、逮捕、威胁等手段，以压制7月9日的和平集会。

文告表示，根据可靠的消息指出，至少有150人被传召、逮捕或控告，其中还有在野党的国会领袖。"社运分子只不过因拥有净选盟的黄衣和运动传单就遭执政者逮捕。"

文告表示，该机构关注马来西亚政府近日采取的举措，导致言论自由紧缩，这包括采取防范性逮捕以及宣布净选盟为非法组织。、

文告呼吁马来西亚政府释放那些和平地行使表达自由者，并呼吁政府废除《1969年紧急法令》等预防性拘捕法令。这是联合国人权事务高级专员办公室任意拘留问题工作组早已呼吁的事项。

马来西亚目前是联合国人权理事会成员，任期在2013年6月18日届满。

An opposition MP and five other activists calling for reform to Malaysia’s electoral system have been detained without charge, and are at risk of torture.

The Malaysian authorities used the country's Emergency Ordinance on 2 July to keep a member of parliament, Dr Jeyakumar Devaraj, and five other activists in detention. This law allows for detention without charge and prevents judicial review.

The six men are among 30 arrested in the city of Penang on 25 June en route to an event for an electoral reform movement, Bersih 2.0 ("Clean"). Police held them for seven days on suspicion of "waging of war against the King". The other 24 were released on 4 July but charged with associating with Bersih 2.0, which was not declared an illegal organization until after their arrest.

On 4 July, police barred lawyers from meeting with the six men, who have not yet been allowed to see a lawyer.

Prompt access to legal counsel is a key right of detainees, and an important safeguard against torture and other ill-treatment. According to credible local sources, one of the 24 released detainees said she was forced to stand for seven hours during interrogation.

The UN Committee against Torture and the Special Rapporteur on torture have found that painful stress positions such as these constitute cruel, inhuman or degrading treatment and, in particular when combined with other methods, may amount to torture. Torture and other forms of ill-treatment are prohibited absolutely under customary international law, which is binding on all states.

Another detainee said that a police officer punched her when she and other female detainees protested against being ordered to undress in front of male officers. A male officer videotaped the women as they undressed, and officers made sexually degrading comments to the women.

- calling on the authorities to guarantee that the six detained men (naming them) will not be tortured or otherwise ill-treated;

- urging them to allow the men immediate and regular access to lawyers of their choice, their families and an independent court as well as any medical attention they may require;

- urging them to charge the men promptly with a recognizably criminal offence and bring them before a court of law, or else release them;

- expressing concern that the Emergency Ordinance violates human rights, as set out in the Universal Declaration of Human rights, including the right to liberty, the right to a fair and public trial and the right to be presumed innocent;

Under the Emergency (Public Order and Prevention of Crime) Ordinance 1969, police can hold detainees for 60 days without judicial review. After 60 days of questioning, the Home Minister can order further detention for up to two years, a period which is renewable indefinitely.

Like the Internal Security Act, the Emergency Ordinance infringes international human rights standards by enabling indefinite detention without charge or trial. Both Acts deny detainees the right to challenge their detention in a court of law. The Internal Security Act is imposed at a ministerial level, while requests for Emergency Ordinances are made by the police.

People detained under security laws such as the Emergency Ordinance have often been tortured or otherwise ill-treated by Special Branch officers. When police lack evidence to bring charges, the Emergency Ordinance allows them to continue interrogation for a further 60 days after the seven-day remand period ends. The Inspector General of Police can block access to lawyers and family, resulting in incommunicado detention.

The Emergency Ordinance was enacted as a temporary measure in 1969; a state of emergency was declared when ethnic violence flared in the wake of a parliamentary election. More than four decades later, Malaysia has not revoked this emergency legislation.

The UN rights office today urged Malaysia to release opposition politicians and activists detained in the run-up to a peaceful rally, and to repeal preventive laws allowing such arrests.

"We are very concerned about the various measures that are being taken by the authorities to restrict freedom of expression in Malaysia, including preventive detention and the government’s decision to reportedly declare Bersih an unlawful organisation," said Rupert Colville, spokesperson for the UN High Commissioner for Human Rights in Geneva.

Electoral reform group Bersih is organising a rally on Saturday which they have said would be peaceful.

But police have arrested about 150 opposition politicians and activists over the past week for trying to drum up support for the rally. Most have been released after questioning.

Provisions such as the Internal Security Act and Emergency Ordinance allow police to detain activists, and police have said that the planned rally is illegal as it has not been granted permission.

"We call on the authorities to release all those being detained for peacefully exercising their freedom of expression and urge the government to take steps to repeal preventive laws," said Colville.
