United Nations should strip Malaysia off its membership in the Human Rights Council

“The high number of votes obtained reflects the confidence of the international community in Malaysia’s ability to play a positive and constructive role in the work of the HRC. “It is an acknowledgement of our contribution towards enriching the quality of dialogue, cooperation and action aimed at advancing the promotion and protection of human rights globally.

“It also signifies the international community’s recognition and appreciation of Malaysia’s commitment to respecting and upholding the inalienable and invisible nature of all human rights at the international and domestic levels”.

This is the statement issued by the Malaysian government when it was re-elected to the United Nations Human Rights Council (HRC) to serve a three-year term from June 19, 2010 to June 18, 2013.

Now, even more than before, this statement looks like a joke.

This morning an unruly mob of police officers raided the Bersih 2.0 secretariat without a warrant. According to Maria Chin Abdullah, who heads the NGO Empower, the police were aggressive and tried to break the door with a cutter.

Home Minister Hishammuddin Hussein has declared the Bersih 2.0 t-shirts illegal.

In a widening crackdown more Pakatan Rakyat leaders have been called-in by the police for questioning over the July 9th rally.

Some PSM women detainees, who were detained for allegedly spreading communism and supporting the rally, were spat on, kicked on the legs, told to drink water from the toilet bowl and forced to change into lock-up clothes in the presence of male police officers.

These are serious violations of human rights perpetrated by the BarisanNasional/UMNO government. The government has clearly crossed the line and demonstrated that it cares two hoots about human rights in the country.

Using the police and UMNO goons to intimidate activists, civil society members and opposition politicians reek of abuse of power and blatant disregard for the law.

The Bersih 2.0 rally is a call for electoral and institutional reforms. A call which has been largely ignored by the Election Commission.

Abuses such as vote rigging, gerrymandering, vote buying and phantom voting have been permanent features during the elections.

Therefore, people would march on the streets calling for indelible ink to be used, electoral roll to be cleaned up, postal voting to be reformed and all political parties to be given access to the media.

Bersih 2.0 also calls for a minimum 21 day campaign period, stop to dirty politics and corruption and the strengthening of public institutions.

In radical contrast the government has given the rally a spin, calling it an illegal assembly organized to topple Prime Minister NajibTunRazak’s administration.

Gullible self-promoter Ibrahim Ali has issued warnings against the Chinese to stay indoors on July 9. His verbose claim that the rally is a tool to pit the Malays against each other is nonsensical and threatens to destroy the social fabric of the society.

If this is not enough, UMNO youth members threatened to torch the PKR headquarters two nights back.

Ibrahim Ali was let off with three hours of questioning and the UMNO thugs are yet to be called in by the police. But those who support the call for free and fair elections are being harassed by the police, under instructions from UMNO.

This caricatures the government’s high handedness and complacency to the propagation of human rights in the country. We are expecting the worse to come as the nation gears for July 9.

It’s time for the government to stop pretending that it cares about human rights in the country. Arbitrary arrests, inhumane treatment of detainees and silencing of legitimate dissent are not marks of a democratic nation.

Therefore I call upon the United Nations to strip Malaysia off its membership in the Human Rights Council. The UMNO-led ruling government certainly does not deserve to be on the Council.

இவ்வாரம் மிகவும் கவலைக்கிடமான வாரமாக தோன்றுகிறது. எத்திசை பார்த்தாலும் மக்களை போலீஸ் கைது செய்துக் கொண்டிருக்கின்றனர் என கிள்ளான் நாடாளுமன்ற உறுப்பினர் சார்ல்ஸ் சந்தியாகோ கூறினார்.

பேரணியை ஆதரிப்பதாலும் அப்பேரணியில் கலந்துக் கொள்ள கூறியதாலும் செனட்டர் ராமக்கிரிஷ்ணனையும் கைது செய்தனர். பெர்சே 2.0 தலைவர் எஸ் அம்பிகாவையும் தேசிய இலக்கியவாதி எ சமாட் சையட்டையும் தேசத் துரோகம் சட்டவிரோதக் கூட்டம் ஆகிய சந்தேகத்தின் பேரில் போலீசார் நேற்று விசாரித்தனர்.

மறுபுறம், சுங்கை சிப்புட் எம்பி டி.ஜெயக்குமார் உள்பட 30 மலேசிய சோசலிசக் கட்சி (பிஎஸ்எம்) உறுப்பினர்களையும் "அகோங்குக்கு எதிராகப் போர் தொடுத்த" குற்றச்சாட்டின்பேரில் குற்றவியல் சட்டம் பிரிவு 122-இன்கீழ் விசாரணை மேற்கொண்டு வருகின்றனர்.

பேரணி தொடர்பில் கடந்த புதன்கிழமை தொடங்கி இதுவரை 81 பேர் கைது செய்யப்பட்டுள்ளனர். பேரணி தேதி நெருங்க நெருங்க மேலும் பலர் கைதாகலாம் என எதிர்பார்க்கப்படுகிறது.

ஆயினும் இவர்களது செயல் அடிப்படையற்றது. இது எதிர்வரும் பெர்சே 2.0 பேரணிக்கு ஆதரவு தெரிவிப்போரை அடக்கி ஒடுக்கி நோக்கில் மேற்கோள்ளப்பட்ட நடவடிக்கைதானே தவிர வேறு ஒன்றுமில்லை என்கின்றனர்.

ஆனால், பெர்சே 2 .0 ஒரு அமைதி போராட்டம். தேர்தல் முறைகளை மாற்றச் சொல்லி மக்கள் தனது குரலை எழுப்பும் கூட்டம். இதில் தேர்தல் ஆணையத்திடம் தபால் வாக்குகளில் சீர்திருத்தம், நிரந்தரமான அல்லது அழியாத மை உபயோகித்தல், தேர்ந்தெடுப்பவர் பதிவுகளை சுத்தப்படுத்துவது, அனைத்து தரப்பினரும் தகவல் சாதனங்களை தொடர்புக் கொள்ள முடிவதை உறுதி செய்தல் மற்றும் தேர்தல் பிரச்சாரத்திற்கு குறைந்த பட்சம் 21-நாட்கள் அறிமுகப்படுத்துதல் ஆகிய கோரிக்கைகளை விடுத்துள்ளது. ஆனால் நியாயமான இந்த கோரிக்கைகளுக்கு தேர்தல் ஆணையம் செவி சாய்ப்பதாக தெரியவில்லை.

இதை மாற்ற வேண்டும். தேர்தலில் மாற்றத்தைக் கொண்டு வர வேண்டும் என்பதற்காக 62 அரசு சார்பற்ற இயக்கங்கள் ஒன்றிணைந்து சுதந்திரமான நேர்மையான தேர்தலை உருவாக்க வேண்டும் எனும் எண்ணத்தில் மன்னரிடம் மனு வழங்கும் இப்பேரணி எப்படி "அகோங்குக்கு எதிராகப் போர்" தொடுத்தலாகும் என கேள்வி எழுப்பினார் சார்ல்ஸ்.

மலேசியா ஒரு ஜனநாயக நாடு. ஒரு ஜனநாயக நாட்டில் மக்கள் தனது கருத்துகளை தெரிவிக்க அனைத்து உரிமைகளும் உண்டு. அதுவே நல்ல ஜனநாயகத்திற்கு அழகு. ஆனால் மலேசியாவிலோ எல்லாம் தலைகீழாக நடந்துக் கொண்டிருக்கிறது. 

இம்மாதிரி கைது செய்து பேரணியை தடுப்பது, பெர்சே 2.0 ஜூலை 9-இல் நடத்தத் திட்டமிட்டிருக்கும் பேரணிக்கு எதிராக பிஎன் தலைவர்கள் எச்சரிக்கைகளையும் மிரட்டலையும் விடுத்து வருவது, போலீஸார் நாடு முழுக்க அந்தத் தேர்தல் கண்காணிப்பு அமைப்புக்கு எதிராகவும் மாற்றரசுக் கட்சிகளுக்கு எதிராகவும் கைது நடவடிக்கைகளை முடுக்கி விட்டிருப்பது எல்லாம் ஜனநாயகத்திற்கு புறம்பானது.

ஆகவே கைது செய்யப் பட்ட அந்த 81 பேர்களையும் விடுவிக்குமாறும் மேலும் கைது செய்வதை நிறுத்துமாறும் கேட்டுக் கொள்வதாக சார்ல்ஸ் தெரிவித்தார்.

நாம் நமது உரிமைக்காக ஒன்றிணைந்து போராடியே ஆக வேண்டும். அரசாங்கம் மற்றும் போலீஸ் காரர்களின் அராஜகத்தால் நாம் ஊமையாகி விடக் கூடாது. தொடர்ந்து இணைந்து போராட வேண்டும். நமக்கென்ன என்று இருந்து விட்டால் நமது தேவைக்கு யாரும் வர மாட்டார்கள் என்பதனை நினைவுறுத்தி மக்கள் பலமே, பலத்தில் சிறந்த பலம் என்றும் ஜூலை 9-ல் கூடி நமது கருத்தை தெரிவிப்போம் எனவும் கேட்டுக் கொண்டார் சார்ல்ஸ்.

தொழிலாளர்களின் குறைந்த பட்ச சம்பளத்தை நிர்ணயிப்பதற்காக தேசிய சம்பள ஆலோசனை மன்றம் ஒன்றை உருவாக்கியுள்ளனர். அம்மன்றத்தில் எடுக்கப்படும் முடிவுகள் பிரதமர் துறைக்கு கொண்டு செல்லப்படும். ஆயினும் இறுதி முடிவு பிரதமர் துறையில் எடுக்கும் முடிவே ஆகும் என விளக்கிய கிள்ளான் நாடாளுமன்ற உறுப்பினர் சார்ல்ஸ் சந்தியாகோ, அதற்கு அந்த மன்றம் இல்லாமல் இருப்பதே மேல் என்றார்.

அம்மன்றம் இயங்குவதால், மக்களின் நிதிதான் வீணாகிறது. அதுமட்டுமின்றி, பல நிர்வாகக் கட்டுபாடுகளை கடைபிடிப்பதால் காலம் தாமதமாக்குவது முறையல்ல. இதுவெல்லாம் போக அம்மன்றத்தில் எடுக்கும் முடிவுக்கு மதிப்பிருப்பதாக தெரியவில்லை என்றார் சார்ல்ஸ்.

மலேசியாவில் குறைந்த பட்ச சம்பளத்திற்கு அர்த்தம் இல்லாமல் இருக்கிறது என கூறிய சார்ல்ஸ், குறைந்த பட்ச சம்பளம் என்பது மக்கள் அவர்களின் வறுமை நிலையிலிருந்து மீளவும், அவர்களின் உழைப்பிற்கு தகுந்த ஊதியமாக இருத்தல் வேண்டும். அச்சம்பளம் வாழ்க்கை நடத்த ஏதுவாக இருக்க வேண்டுமே தவிர, அவர்களை மேலும் வறுமைக்கு இட்டுச் செல்லக் கூடாது.

உதாரணத்திற்கு நாட்டிலுள்ள பாதுகாவாலர்களின் குறைந்த பட்ச சம்பளம் வறுமை கோட்டிற்கு கீழ் உள்ளது. நாளுக்கு நாள் விலைவாசி ஏறிக்கொண்டிருக்கும் இக்காலக்கட்டத்தில் ரிம 500 – ரிம 700 வாழ்க்கை நடத்த போதுமானதா? என கேள்வியும் எழுப்பினார் சார்ல்ஸ்.

ஆகவே, குறைந்த பட்ச சம்பளத்தை நியமிக்கும் மன்றம் சுயேட்சையாகவும், தன்னாட்சிமிக்கவையாக இருத்தல் வேண்டும். அதில் பிரதமர் அல்லது அமைச்சர் துறை தலையீடு இருத்தல் கூடாது. அம்மன்றத்தில் உள்ள பிரதிநிதிகள் முதலாளி அமைப்புகளிலிருந்தும் தொழிலாளர்கள் சங்கத்திலிருந்தும் தேர்தெடுக்கப் பட்டவர்களாக இருத்தல் வேண்டும்.

அவர்களுக்கு தொழிலாளர்கள் சட்டம் தெரிந்திருக்க வேண்டும். அவர்கள் அரசாங்க பிரதிநிதிகளுடன் கருத்து பரிமாற்றம் செய்யலாம் ஆனால் இறுதி முடிவு அந்த மன்ற பிரதிநிதிகளானாதாக இருத்தல் வேண்டும். அந்த முடிவு எல்லா தரப்பினர்களுக்கும் சாதகமானதாக இருத்தல் வேண்டும். அந்த முடிவே கன்னியமான சம்பளமாக அமலாக்கத்திற்கு கொண்டு வர வேண்டும் என சார்ல்ஸ் கேட்டுக் கொண்டார்.

I can confidently say that the ruling politicians are shivering in their pants, says DAP MP Charles Santiago.

It has been a rather disturbing week. It has also been a circus choreographed by the ruling Umno/BN government and acted out by the police.

Weeding through rambling comments made by Umno leaders, reports about activists and opposition politicians summoned to give statements at police stations and the arrests made by the police ahead of the July 9 Bersih rally, I can confidently say that the ruling politicians are shivering in their pants.

As I write this, the total number of people arrested to thwart the rally has exceeded 80. My colleague Senator Ramakrishnan Suppiah was detained for asking people to join the rally at a DAP dinner on Monday.

Bersih chief S Ambiga and national laureate A Samad Said were also questioned. The renowned poet was interrogated for his poem on the rally, which the police claimed to be seditious.

More people are expected to be arrested in the next two weeks. And the harassment is nothing but pure bully-boy tactic to prevent the tens of thousands of Malaysians from gathering to call for electoral reforms.

Many of those arrested are being investigated for "waging war against the King". These charges are baseless and a mere witch-hunt to stop the rally at all cost.

Bersih is not about the organizers. It is also not about the opposition leaders or prominent civil society representatives. It is a movement by the people to re-claim their right to a clean electoral process.

The government simply does not get this.

Waging war against the King?

When I meet people and find myself discussing about the arrests and warnings issued to stop the rally, their sentiments echo the fact that the government is rattled about peoples' power or the political awakening of a society which has largely been under the grips of the ruling government for more than five decades.

I also sense their anger against a government which would do anything to stay in power. And clearly at the expense of the rakyat.

Bersih is a coalition of 62 non-governmental organizations which zeroes in on meaningful electoral reforms. It has lobbied the Election Commission to reform postal voting, clean-up the electoral role, use indelible ink, allow all parties access to the media and introduce a minimum 21-day campaign period.

The Election Commission has not just shown strong resistance for any reforms but media reports indicate that they have closed the doors to Bersih permanently.

The planned rally is a peaceful gathering by Malaysians to show their dissatisfaction at the current electoral system and demand for changes to nip the abuses such as vote rigging, vote buying, phantom voting and gerrymandering which have been common features all these years.

A memorandum would be sent to the King to ask him to intervene and make the implementation of these reforms possible. How would this amount to "waging war against the King"?

The circus clowns

In the circus I have witnessed over the last week, some politicians have proved themselves to be clowns.

Information, Communication and Culture minister, Rais Yatim, has shot off his mouth saying that PSM were "desperate parties" who were using an "evil and illegal" ideology to gain support for the rally.

He had also said that "spreading communism is against the law". The learned minister could not differentiate socialism from communism.

Ibrahim Ali keeps insisting that Bersih is a covert effort to instigate the Malays to clash against each other. Again these are baseless allegations used to create confusion and fear among the public.

Freedom of assembly, expression and speech are key indices of democracy. They form the backbone of democratic nations. In Malaysia, we see the exact opposite.

Arrests to stop the rally, cloaked warnings and veiled threats are blatant examples of restrictive democracy. Fashioning the rally as an attempt to topple the government is the mark of a dictatorship.

As such, I call on the police to immediately release all the 81 people who have been arrested and stop further arrests.

Stand up to unite

Let's not be cowed into submission by dictators. Let's take to the streets on July 9 to demand for our right to free and fair elections. As I say this, I am reminded of the German theologian Martin Niemoller.

The text of Niemoller's statement is usually presented as follows:

First they came for the communists,

and I didn't speak out because I wasn't a communist.

Then they came for the trade unionists,

and I didn't speak out because I wasn't a trade unionist.

Then they came for the Jews,

and I didn't speak out because I wasn't a Jew.

Then they came for me

and there was no one left to speak out for me.

Malaysians need to stand up united to fight against an electoral system which is riddled by abuses to serve the interest of the ruling elite. We cannot allow the high handedness of the government or police to silence us.

Otherwise, when they come for you, there will be no one left to speak out…
