I was at the George Town Magistrate Court I for inquest's verdict on Chung Ling High School Dragon boat tragedy to show my support to the family.





Criminal element ruled out

GEORGE TOWN: The coroner's court yesterday returned a verdict of misadventure in the inquest into the dragon boat tragedy which claimed the lives of a teacher and five students on Jan 17 last year.

Coroner Noor Aini Yusof found that there were no criminal elements or sabotage in the tragedy which resulted in the deaths of Chung Ling High School teacher Chin Aik Siang, 28, and students Jason Ch'ng, Goh Yi Zhang, Brandon Yeoh Yuen Khye, Cheah Zi Jun, all 17, and Wang Yong Xiang, 16.

Some 30 witnesses, including students who survived the boat accident, testified in the inquest over six days.


Noor Aini said the purpose of the inquest was to determine when, where, how, in what manner and if there were criminal elements involved in the death of the six.

"Based on the testimonies of the witnesses, the incident happened when the dragon boat was hit by strong waves as they were turning back towards the jetty at the waterfront of Gat Lebuh Macallum.

"The boat then hit an iron barge, sank and was sucked underneath the barge.


"Of the 18 who went out that day, 10 students and two coaches survived, while the six perished," she said, adding that the six had died at the waterfront of Gat Lebuh Macallum and its surrounding areas.

Noor Aini also said it was clear the six had died from drowning, as stated in the post-mortem reports.

"A majority of them had not worn life jackets despite having the jackets supplied to them and told to do so by their coaches.


"Only two individuals wore life jackets. The others were either wearing a T-shirt or not wearing a shirt."

Noor Aini said the swift currents on the day were caused by the forces of nature.

She added that the intention of the inquest was not to point fingers at anyone, noting that as a coroner, she had no right to determine if there was negligence on the part of the school, its dragon boat club, the Penang Forward Sports Club or any other quarters involved.

"The six had died on Jan 17 last year at 9am. The cause of death is drowning.

"There are no criminal elements which resulted in the death of the six," Noor Aini said in closing the inquest proceedings.

Deputy public prosecutors Suhaimi Ibrahim, Tan Guat Cheng and Pang Chuin Keat assisted the court in the inquest while Counsel Tham Shien Shyong and Lau Jun Yi held a watching brief for the school.

Meanwhile, former student and Air Itam assemblyman Wong Hon Wai, who was present to lend moral support, said everyone should learn from the tragedy, which was costly as it involved the loss of lives.

Wang Hong Gan, 57, the father of Yong Xiang, said he could not accept the court's verdict.

"My heart still aches. Even if I appeal, it will not bring my son back.

"My son is gone," said Wang, who was the only parent present in court yesterday.


验尸庭:未涉刑事人为破坏 龙舟惨剧纯属意外

(槟城13日讯)轰动全国的钟灵中学龙舟队翻覆酿六名师生溺毙惨剧,验尸庭今日裁决,这起事件纯属意外事故导致,不涉及任何刑事因素或人为蓄意破坏成分。

验尸官诺艾妮也根据法医解剖报告裁定,六名死者即一名老师及五名学生的死因是于事发当天即2010年1月17日上午9时在五条路及附近一带海域溺毙。

验尸庭无权追究

她说,法庭也根据三名引导官的引导及30名证人供证下,鉴定这起意外的导因,即当时在五条路海域进行训练的龙舟队18名师生欲作第二次转弯返回码头时,龙舟遭到海浪冲击撞向铁船翻覆,急流将船员吸入铁船底下,导致六名死者罹难,其余10名学生及两名教练幸存。

不过,法庭提醒,召开这项验尸庭主要是鉴定这起意外的六项疑问,法庭没有权力也并非要向钟灵中学校方、学校龙舟队、槟州前进体育会或任何一方追究责任。

于去年11月1日召开的钟灵中学龙舟队翻覆意外验尸庭,是经过长达6天的审讯及传召多达30名证人供证后,于今日作出这项裁决,并宣布此案正式审结。

家属:口供有疑点

出庭听判的三名学生死者家属,即黄雍翔的父亲黄鸿彦、谢子俊的父亲谢震山医生及杨延开的小姑,即杨瑞玲的妹妹在聆判后,皆一脸无奈的步出法庭。

现年57岁的黄鸿彦在法庭外受访时指出,虽然出庭的死者家属都对法庭的判决感到不理想,包括部分证人的口供出现疑点及有人推卸责任,不过,都痛心的接受事实。

不过,令他无法接受的是,槟城前进体育会龙舟队竟然在知道农历初三及初十八海浪大及有急流,还允许学生冒险出海训练,这些都是可以被避免的。

询及家属是否将再上诉,为了让已离开的孩子们能够得到安息,他以一句:"算了吧!"作出回应。他说,除非上诉可以让孩子复活,否则已无大意义。

18师生仅2人穿救生衣

验尸官诺艾妮指出,根据证人供证及呈堂证据的照片显示,出事的龙舟队18名师生及两名教练当中,仅有两人有穿上救生衣,其余的皆没有穿上。

她说,根据证人指出,事发当天有准备充足的救生衣,而教练也指示穿上救生衣,但仅有两人穿上。

她说,证人也供证指其余没有穿上救生衣的人,一些有穿衣服,一些则赤裸着上身。

她是于今日上午在槟城推事庭召开的验尸庭上对钟灵中学龙舟队翻覆意外作出判决时,这么指出。

无论如何,她总结验尸庭的判决,指这起意外纯属由大自然灾害(Bencana Alam)的急流引发的意外事故(Misadventure),造成六名师生溺毙,并没有涉及任何刑事因素。

鉴定6疑问找出答案

验尸官诺艾妮指出,钟灵中学龙舟队翻覆意外验尸庭,是根据刑事程序法典第337条文召开,主要是鉴定这起意外中的六项疑问找出答案,即六名师生在哪里死亡、何时死亡、如何死亡、什么情况下导致死亡、是否有人为刑事成分或蓄意破坏、以及是否有其他刑事因素。

秦裕翔家人缺席

她说,于去年11月1日召开验尸庭总共展开六天的审讯,即从11月1日至4日,以及12月29及30日。

她说,被传召供证的30名证人,大多数是在意外中幸存的学生及教练,不过,在验尸庭审讯及供证期间,其中一名死者即罹难的龙舟队顾问老师秦裕翔的家人,从开审至审结皆未出庭。

她说,验尸庭由三名副检察司引导,即首席引导官苏海米依布拉欣、陈钥锖及彭俊杰,而钟灵中学的代表律师是谭贤雄。

蔡耀祖:校方有代表聆判

槟城钟灵中学校长蔡耀祖于较后被记者联络上时,表示校方有派一名主任出席聆判,但不愿对验尸庭判决置评。

他说,校方今早有多项会议要开,以及接待国外的访问团。

林子辉:未接通知

槟城前进体育会主席林子辉则在接受记者电话询问时表示,因没有接到通知,本身迟至昨晚最后一分钟才得知验尸庭今日宣布判决,加上今早必须在浮罗山背法庭处理一些案件,因此无法出庭聆判也没有安排代表出庭。

他对验尸庭的判决表示是意料之中,毕竟验尸庭的范围不能对任何方面追究责任,所扮演的角色只能公开式的调查,及对30名证人的供证作出评估。

针对死者家属对验尸庭的判决感到失望,他表示能够体会,并促请死者家属能够站在法庭立场看待,也对死者家属痛失家人即将届满一周年深感抱歉,希望死者家属能够随着时间的流逝平复心情,重新站起来。

以亚依淡区州议员兼钟灵中学校友身分出席听判的槟州行政议员黄汉伟对验尸庭的裁决,认为这是一个必须经过的法庭程序。

他促请社会人士从这起夺走人命的惨剧中吸取教训,采取防范措施避免悲剧重演。
