Malaysia: End mass repression of pro-reform activists

Malaysian authorities are arbitrarily arresting and detaining scores of peaceful electoral reform protesters in the worse repression of free speech and freedom of assembly in recent years, Amnesty International said today.

Among those currently detained are 30 peaceful activists from the Socialist Party who were denied review of their detention today under accusations of "waging war against the king".

Since 24 June, more than 100 activists have been arrested or questioned by police over their support of an electoral reform rally. The demonstration is being planned for 9 July by the Coalition for Fair and Free Elections, also known as Bersih 2.0, meaning 'Clean'.

"The Malaysian authorities are muzzling calls for electoral reform by throwing peaceful protestors in jail," said Donna Guest, Deputy Asia-Pacific Director at Amnesty International. "We have not seen such a crackdown on political activists across Malaysia in many years."

People have been arrested for as little as wearing yellow (the colour of Bersih 2.0), are being held without charge, and face investigation for sedition and unlawful assembly.  The government has also threatened to invoke the draconian Internal Security Act over the rally, allowing for indefinite detention without trial.

"Malaysia is undermining its claim to be a moderate democracy through this campaign of repression," said Donna Guest.

Amnesty International is calling for Malaysia to immediately release all activists or charge them with a recognizably criminal offence , drop unfounded charges, and respect the right to freedom of expression and peaceful assembly.

Today, the Penang High Court dismissed a review of the arbitrary detention of 30 Socialist Party activists, remanding them without charge for "waging war against the king," which is punishable by life imprisonment.  The activists, including two children, were arrested en route to a Bersih 2.0 event in Penang on 25 June.

Among these detainees is Socialist Party member of parliament Dr Jeyakumar Devaraj, who was denied access to essential heart medication for 15 hours while in detention, before being sent to a hospital for treatment.

Four more people were arrested and released today, including a Perak state assemblymen and a member of parliament, for wearing yellow.

On 29 June, police raided the office of the Bersih 2.0 Secretariat without a warrant, briefly detaining seven people and confiscating laptops, cameras, and rally materials.

The chair of the Bersih 2.0 Organising committee, prominent lawyer Datuk Ambiga Sreenevasan, and Malaysian Poet Laureate A Samad Said are both being investigated by police under the Sedition Act and Police Act for organising an "unlawful assembly".

Malaysia's home minister, Hishammuddin Hussein, threatened on 26 June to invoke the Internal Security Act against rally organisers, on the grounds of national security.

"This repression is clearly politically motivated to intimidate people from marching for electoral reform," said Donna Guest. "The use of repressive laws to criminalise peaceful political activism is appalling."

Bersih 2.0 plans to hold the 9 July rally to demand a set of electoral reforms. These include fair access of all political parties to the media, reform of postal ballots and revisions of the electoral roll to address irregularities.

此外,警方也扩大了对民联领袖的镇压,更多民联领袖被传召到警局录口供。

犹有甚者,社会主义党被扣留的女性社运分子也投诉,他们被警方拳打脚踢,被吐口水,也要他们喝马桶的水,并被迫在男警面前患上扣留者的衣服。

查尔斯表示,这些都是国阵巫统政府严重的侵权行为。政府明显已过分了,并且显示了他们根本不在乎国家的人权。

"使用警察和巫统的暴徒来恐吓社运人士、民间组织成员和在野党领袖滥权且无视法律。"

不应成为人权委员会成员

马来西亚于2010年6月19日重获联合国人权委员会资格后,马来西亚政府曾说:"马来西亚获得高票显示了国际社会对马来西亚能在人权工作扮演积极和创造性角色的能力有信心。这是承认我们在推广和保护全球人权方面的贡献,以加强对话、合作和行动的素质。"

"这也显示了国际社会承认和感激马来西亚,在国内和国际上尊重和捍卫所有不可分割和隐形的人权特质。"

查尔斯认为,这两段话如今看起来如同笑话。马来西亚的联合国人权委员会的任期将在2013年6月18日届满。

查尔斯认为,净选盟要求选举制度改革,但一直受到选举委员会的漠视。选举弊端如操纵选票、选区划分不均、贿选、幽灵选民等都是我国选举时的常态。

因此,人民要上街要求使用不退色油墨、清理选民册、改革邮寄选票和所有政党可近用媒体。

净选盟也要求至少21天竞选期、停止肮脏政治和贪污并加强公共机构。

查尔斯促请政府不要再假装他们关注人权,首相纳吉扭曲该集会为尝试夺权的非法集会、土著权威组织主席依布拉欣阿里(Ibrahim Ali)也警告华裔留在家中并囤粮、巫统青年团成员也恫言焚烧公正党的总部等事件。

特也说,然而,依布拉欣阿里只被盘问了三小时就获释,而巫统流氓却未受警方传召,反之那些支持自由和公平选举的人士,在巫统的指示下遭警察骚扰。

Malaysia sits in the UN Human Rights Council. But Klang MP Charles Santiago says the country should be stripped of its membership, with all the violations happening now.

PETALING JAYA: Malaysia is a member of the UN Human Rights Council and its main purpose is addressing human rights violations.

But judging from the blatant abuse of human rights here over the last two weeks, Malaysia's very presence in the council is likely to be questioned.

The Human Rights Council was created by the UN General Assembly on March 15, 2006, aimed mainly at addressing human rights violations and make recommendations on them.

Malaysia was re-elected to the UN Human Rights Council on June 19, 2008. It will serve a three- year term which ends in 2013.

Klang MP Charles Santiago says the Barisan Nasional (BN) government does not care for human rights in the country and the UN should strip Malaysia of its membership of the Human Rights Council.

Santiago said the government should stop making a mockery of the council.

"It's time the government stopped pretending that it cares about human rights in the country. Arbitrary arrests, inhumane treatment of detainees and silencing of legitimate dissent are not marks of a democratic nation," he said.

The clampdown on the Bersih's planned "Walk for Democracy" on July 9 has been intensifying. This morning, 14 people including DAP Jalong assemblywoman Leong Mee Meng and PKR Teja assemblyman Chang Lih Kang were taken in by police in Sungai Siput for promoting the rally.

In the afternoon, police raided the office of Bersih office in Petaling Jaya. Selangor police chief Tun Hisan Tun Hamzah said the raid was conducted following a tip-off that there were illegal activities taking place in the premises.

He also said that his officers had seized hundreds of Bersih T-shirts and other Bersih apparels from the office.

Government's high-handedness

Home Minister Hishammuddin Hussein today said that it was illegal to wear the yellow Bersih 2.0 T-shirts as it was associated with illegal activities.

To date, about 100 people have been caught for wearing the T-shirts. Bersih has said that it will not apply for a permit for its rally because the government had already warned that it will not issue any permits.

Over the weekend, the police arrested 30 Parti Socialis Malaysia (PSM) members, including Sungai Siput MP, Dr Michael Jeyakumar Devaraj, in Penang and they have been remanded for a week to be investigated for illegal assembly and waging war against the king.

PSM has clarified that the arrests were not related to Bersih but linked to its own campaign, "Udahla Tu… Bersarala" (Enough already – retire now).

Bersih chairman S Ambiga, national laureate A Samad Said, Perkasa chief Ibrahim Ali and an Umno Youth representative were quizzed on Monday.

Yesterday, PKR vice-president Nurrul Izzah, Subang MP R Sivarasa, and lawyers N Surendran and Fadiah Nadwa Fitri (from legal aid organisation Lawyers for Liberty) were also summoned to give their statements at the Dang Wangi police station.

Opposition Leader Anwar Ibrahim was also questioned by the police today.

A few more leaders such as Bersih steering committee member Maria Chin Abdullah and DAP Seputeh MP Teresa Kok are scheduled to give their statements today.

Santiago said that all these developments demonstrates the government's high-handedness and disregard for human rights in the country.

KUALA LUMPUR, June 29 — The United Nations (UN) should remove Malaysia as a member of the Human Rights Council (HRC) in light of the government's crackdown on Bersih supporters, the DAP said.

DAP MP Charles Santiago said that the alarming rate of arrests over the past few days was "serious violations of human rights." This, he said showed that the government had no qualms about abusing human rights in the country.

"It's time for the government to stop pretending that it cares about human rights in the country … arbitrary arrests, the inhumane treatment of detainees and the silencing of legitimate dissent are not marks of a democratic nation.

"I call upon the UN to strip Malaysia of its membership of the Human Rights Council. The Umno-led ruling government does not deserve to be on the council," Santiago said in a statement today.

Home Minister Datuk Seri Hishammuddin Hussein said today T-shirts with messages in support of Bersih have been outlawed because they were related to an illegal assembly.

Police officers have arrested activists and opposition members wearing Bersih T-shirts ahead of next weekend's rally and counter-rallies organised by Umno Youth and Perkasa, all of which the government has said will not be given police permits.

However, the Bersih organisation has not been declared illegal nor has the word "Bersih" been gazetted as such.Hishammuddin did not mention under what law the T-shirts would be deemed illegal. The minister has also rejected claims that the police clampdown on those supporting the July 9 march for electoral reforms was politically motivated.

Police officers have also raided the Bersih office in Petaling Jaya and arrested several Bersih activists.

Last weekend, the police also rounded up a group of Parti Sosialis Malaysia (PSM) activists, including Sungai Siput MP Dr Michael Jeyakumar, accusing them of attempting to revive communism. The group had also expressed their support of the July 9 Bersih rally. A number of opposition politicians have also been summoned to have their statements recorded over Bersih.

PKR vice-president Chua Tian Chang demanded that the police explain why only Bersih activists and supporters were being questioned or arrested, and why Perkasa and Umno Youth have not been hauled up despite stating that they will organise a counter-rally on July 9.

"Why the need to arrest Bersih? What have they done wrong? Even if you stop Bersih supporters from wearing T-shirts, you will not be able to stop the spirit of the upcoming rally.

"At the same time, no action has been taken against Umno Youth and Perkasa. Where is the democracy here?" Chua told reporters here today.

Activists under Bersih and Pakatan Rakyat (PR) component parties are gearing up for the rally this July 9, the second such gathering calling for electoral reforms.

The first rally, also organised by Bersih, was held in 2007 and saw some 50,000 people take to the capital's streets.

The gathering eventually descended into chaos when the police deployed tear gas and water cannons on demonstrators.

The historic event has been partly credited for PR's record gains in Election 2008, when the opposition pact was swept to power in five states and won 82 parliamentary seats.

Ketua Menteri Pulau Pinang merangkap Ahli Parlimen Bagan Y.A.B. Lim Guan Eng terkejut apabila mengetahui Kerajaan Persekutuan mengenakan pemotongan subsidi barangan keperluan harian yang membebankan rakyat tetapi masih kekalkan subsidi tinggi bagi gas petroluem cecair, diesel dan petrol yang menguntungkan Penjana Tenaga Bebas (IPP).
Mengikut jawapan yang diberikan oleh Perdana Menteri dan Menteri Kewangan, Datuk Seri Najib Tun Razak di Dewan Rakyat baru-baru ini, subsidi kerajaan bagi barangan keperluan harian seperti padi, beras, gula dan tepung hanya 10% daripada subsidi yang diberikan kepada gas petroluem cecair, diesel dan petrol.

Subsidi yang diberikan kepada gas petroluem cecair, diesel dan petrol pada tahun 2011 adalah RM 10.25 billion (dan telah ditambah sebanyak RM5.6 billion kepada RM15.9 billion kerana kerajaan terpaksa menambah subsidi untuk mengekalkan harga runcit RON95), tetapi subsidi untuk barang-barang keperluan rakyat seperti beras, gula dan tepung hanya RM 1.5 billion. Kenapa Kerajaan Persekutuan tidak memotong subsidi kepada gas petroluem cecair, diesel dan petrol, dan mengembalikan subsidi yang benar-benar dapat meringankan beban rakyat golongan pertengahan dan bawahan tanpa membebankan kedudukan kewangan negara?

Kerajaan yang berjiwa rakyat sepatutnya mengurangkan beban rakyat jelata dan bukannya membantu kroni-kroni mereka untuk mencapai kejayaan. Nampaknya Kerajaan BN buat yang sebaliknya.

Di Dewan Rakyat, Lim bertanya apakah Iangkah Kerajaan dalam mengatasi inflasi dan mengurangkan kesannya terhadap peniaga dan rakyat Malaysia ekoran penarikan subsidi diesel dan statistik kenaikan harga barang mentah, minyak dan diesel sejak lima tahun lalu.

Menteri Kewangan menjelaskan bahawa Kerajaan telah menyediakan peruntukan sebanyak RM23.7 bilion atau 14.6% daripada perbelanjaan mengurus bagi jumlah keseluruhan subsidi untuk tahun 2011. Pecahan terperinci perbelanjaan tahunan subsidi mulai tahun 1999 hingga 2011 adalah seperti dalam Jadual di bawah.

Beliau mengatakan bahawa pada bulan Mei 2011, subsidi gula telah dikurangkan 20 sen yang dijangka memberi penjimatan sebanyak RM117 juta. Walau bagaimanapun, Kerajaan masih lagi menanggung subsidi gula sebanyak RM283 juta. Selain itu, pemansuhan diesel super subsidi bagi pengangkutan darat tertentu seperti penggerak utama (prime mover), kargo am dan teksi limosin serta nelayan laut dalam (zon C2) mulai 1 Jun 2011 dijangka menghasilkan penjimatan sebanyak RM712 juta.

Penjimatan daripada pemotongan subsidi tersebut tak sampai RM 1 billion tetapi tetap telah membebankan rakyat. Sebaliknya subsidi untuk gas dan minyak telah bertambah.

Mengikut Jadual Subsidi Tahunan, berbanding dengan tahun lepas, semua subsidi tahun ini untuk syarikat besar naik kecuali subsidi untuk rakyat biasa telah turun. Ini memberikan gambaran bahawa kerajaan persekutuan lebih memberikan prihatin kepada syarikat besar dan kaya daripada rakyat miskin. Contohnya subsidi untuk gas dan minyak telah naik daripada RM 9,605 juta dalam 2010 kepada RM 10,256 juta dalam 2011 (dan ditambah RM 5.6 billion kepada RM 15.9 billion). Manakala subsidi bantuan kebajikan lain untuk orang miskin telah turun daripada RM 2,376 juta untuk 2010 kepada RM 1,879 juta untuk 2011. Subsidi untuk beras dan gula pun telah turun daripada RM 1,927 juta untuk 2010 kepada RM 1,572 juta untuk 2011. Dan lagi, insentif untuk membantu petani, nelayan dan penternak bagi meningkatkan pengeluaran makanan pun telah turun daripada RM 524 juta untuk 2010 kepada RM 401 juta untuk 2011.

Jelas dalam gelombang pengurangan subsidi, subsidi untuk rakyat biasa dan miskin dipotong lebih secara perbandingan dengan subsidi untuk korporat.

*** Kerajaan Persekutuan telah menambah peruntukan bagi subsidi petroleum, diesel dan LPG sebanyak RM 5.6 billion daripada RM 10.3 billion kepada RM 15.9 billion bagi tahun 2011. Begitu juga dengan subsidi minyak masak di bawah Skim Penstabilan Harga Minyak Masak ditambah sebanyak RM 700 juta daripada RM 928 juta kepada RM 1.6 billion bagi tahun 2011, menjadikan jumlah besar Perbelanjaan subsidi RM 30 billion. *****

槟州首席部长兼峇眼区国会议员林冠英对联邦政府选择削减必需品的津贴,增加平民百姓的负担,但却维持利惠独立发电厂的天然气、柴油及汽油津贴感到震惊。

根据首相兼财政部长拿督斯里纳吉在最近的国会下议院回答指出,联邦政府付给日用品如稻米、白糖及面粉等的津贴,只佔政府付给天然气、柴油及汽油津贴的10%。

在2011年预算,政府给天然气、柴油及汽油的津贴为102亿5千万令吉(为了维持RON95的零售价,政府更将此部分的津贴额增加了56亿令吉,至159亿令吉),但是,联邦政府对平民百姓所需的日用品,如白米、白糖及面粉的津贴只有15亿令吉。为什么联邦政府不削减付给天然气、柴油及汽油的津贴,并在不影响国家财务地位的情况下,归还真正能够减轻中下阶层负担的津贴?

一个以民为本的政府,本应减轻平民的负担,而不是协助他们的朋党成功。看来国阵政府的民为本是背道而驰的。
林冠英是在国会下议院,询问政府,随着取消柴油津贴后,有何妙计应对通膨及减轻对人民及商家的影响,并要求列出过去5年来原料、油及柴油的涨幅。

财政部长解释道,政府共拨出行政开支的14.6%,或相等于237亿令吉的款项作为2011年度的津贴数目。从1999年至2011年相关的津贴详情,列在以下的图表内。

财长也说,在 2011年5月,政府付给白糖的津贴已经削减了20仙,预料将为政府省下1亿1700万令吉。无论如何,政府依然得承担总额2亿8300万令吉的白糖津贴。此外,政府从今年6月1日起取消一些柴油的津贴,如陆地的主要运输、货运、机场德士及深海渔船的柴油津贴,预料将省下7亿1200万令吉。

这些津贴的削减,在增加人民负担的同时,根本都达不到10亿令吉的节省幅度。反之,政府付给天然气、柴油及汽油的津贴却增加了56亿令吉。

根据年度津贴表显示,与去年相比,联邦政府付给大公司的津贴都有增加,只有削减了付给平民百姓的津贴。这让人对联邦政府的印象,是比较重视富裕的大企业多过贫穷的百姓。比如说,天然气、柴油及汽油的津贴,已从2010年的96亿令吉,增加至2011年的103亿令吉(后来还为了维持零售价而增加56亿令吉至159亿令吉)。而付给穷人的其他援助,已从2010年的23亿7600万令吉,减至2011年的18亿7900万令吉。至于白米及白糖的津贴,也从2010年的 19亿2700万令吉,减至2011年的15亿7200万令吉。再说,付给农夫、渔民及禽畜业者鼓励提高产量的奖掖,也从2010年的5亿2400万令吉,减至2011年的 4亿零100万令吉。
