(吉隆坡30日訊)隨著雪蘭莪州民聯政府通過自由資訊法後,國陣巫青團團長凱里呼吁國陣政府制定自由資訊法,但他強調,危害國家安全和利益的資訊還是應該受到保護。

大馬律師公會週五晚舉辦主題為"自由資訊――你應該知道的權力"

的國會議員對話系列座談會,主講人包括知名法律教授阿布峇卡、林茂區國會議員凱里及民主行動黨巴生區國會議員查爾斯聖地牙哥,吸引逾150來自各界的人士出席。

不危害國家利益

凱里被主持人及一些出席者評為"少數支持自由資訊法的勇敢國陣國會議員",他在講座會上坦承支持自由資訊法,因為這是一個全球趨勢,許多國家都在落實自由資訊法,而且通過這項法令能夠提高政府透明和問責施政,並減少貪污。

"當然,我們個人肯定不要有隱藏的資訊,但是,在國家利益為前提下,政府還是要堅持一些危害國家安全或影響刑事調查的資訊獲得保護。"

他說,州政府顯然比中央政府更輕易就能通過自由資訊法,這是因為州政府無需碰觸涉及國家的安全和防衛等課題。

"我身為一名國陣的議員,確實支持通過這項法令;但是,我也要確保資訊自由後不會危害國家的安全。"

他認為,人民要國陣政府通過自由資訊法,就得使用"伎倆",以"辯論"的方式說服政府。

他舉例說,他曾與內政部長拿督斯里希山慕丁提及廢除內安法令的課題,並提出司法檢討,讓嫌犯帶上法庭面控,甚至讓嫌犯在內庭受審等的建議和解決方案,以期說服對方。

他指出,雪州政府通過自由資訊法是歷史上重要的里程碑,但同時,這項法令還是受到局限和無法延伸發展,並且加劇其未來執實時的困難度。

人民可參與提供發展意見

巴生區國會議員查爾斯聖地牙哥認為,自由資訊法是"權力"(Right),也是問責、治理和透明施政的中心點,能夠減少貪污之餘,也以可讓人民直接參與和提供對相關發展的意見。

他提出,他一直都尋找途徑解密巴生中環巴士總站特許合約、水務稽查報告及特許合約,而雪州議會已經解密巴生中環巴士總站特許合約。

他說,由於中央政府拒絕解密雪州水供管理公司(Syabas)特許合約及水務稽查報告,導致問題在2007年開始被帶上法庭,至今仍在上訴階段。

"雪州政府和雪州水供管理公司都表示可以解密,但中央政府拒絕,這就是為何我們需要自由資訊法。"(光明日報)

KUALA LUMPUR, 30 Julai — Khairy Jamaluddin melahirkan sokongan agar kerajaan menggubal Akta Kebebasan Maklumat tetapi menegaskan, ada beberapa perkara yang berkait rapat dengan kepentingan negara seperti pemerolehan pertahanan tidak boleh didedahkan.

Ketua Pemuda Umno ini berkata, "tiada negara yang akan mendedahkan secara terperinci" tentang hal ketenteraan kerana mahu mengambil kira aspek keselamatan negara.

"Berapa banyak kereta kebal, apa bentuk sistem dan peluru yang kita gunakan tidak boleh dibincangkan di Parlimen dan dirakamkan secara bertulis," kata Ahli Parlimen Rembau pada forum Akta Kebebasan Informasi di Majlis Peguam.

Isu perjanjian ketenteraan mucul apabila pihak berkuasa mengusir seorang peguam dari Perancis yang meneruskan siasatan berhubung kontroversi RM7 bilion dalam pembelian kapal selam Scorpene di mahkamah Perancis.

Walaupun tanpa kehadiran beliau, wakil rakyat Pakatan Rakyat menuduh pentadbiran Najib mahu menyembunyikan fakta dalam pembelian dua kapal selam dari sebuah firma pertahanan Perancis DCNS dan jumlah perjanjian itu meningkat RM16 bilion dalam tempoh tiga tahun.

Bagaimanapun Khairy (gambar) bersama Ahli Parlimen Klang Charles Santiago berkata, jawatankuasa komuniti perkhidmatan ketenteraan perlu diwujudkan dengan dibarisi wakil rakyat dan pasukan bersenjata untuk mendapatkan maklumat daripada pakar-pakar lapangan sebelum dibincangkan secara rahsia.

Ketika ditanya jika keputusan itu masih boleh dibuat secara rahsia, beliau berkata, "bukan semua perkara boleh didedahkan tapi sekurang-kurangnya ahli Parlimen, wakil orang ramai mempunyai maklumat."

Pembelian dua kapal selam dari firma pertahanan Perancis DCNS dibuat pada 2002 di mana ketika itu Datuk Seri Najib Razak memegang jawatan sebagai Menteri Pertahanan dan syarikat milik Abdul Razak Baginda, dikatakan membantu perdana menteri itu mendapatkan komisen lebih daripada RM500 juta.

Kumpulan hak asasi manusia dan parti pembangkang turut mengaitkan isu pembunuhan wanita Mongolia Altantuya Shaariibuu pada 2006. Suara Rakyat Malaysia (Suaram) memfailkan aduan di mahkamah Perancis meminta akses kepada maklumat mengenai perjanjian kerajaan yang ditandatangani Abdul Razak Perimekar Sdn Bhd dan maklumat lain yang diklasifikasikan sebagai rahsia rasmi di Malaysia.

Mahkamah Perancis menerima aduan itu untuk menyiasat dakwaan rasuah berjumlah RM500 juta dari DCNS kepada Perimekar. Peguam Perancis Willian Bourdon tiba di Kuala Lumpur pada 23 Julai lalu di Pulau Pinang di mana beliau bercakap pada satu majlis amal yang dianjurkan Suaram mengenai perjanjian pembelian kapal selam Scorpene namun dihalang menyertai program selanjutnya di ibu negara apabila ditahan pegawai imigresen yang memasuki kapal terbang sebelum mengusirnya.

Sementara itu, Santiago berkata Malaysia bergerak dengan lebih jauh daripada membentuk sebuah jawatankuasa meneliti pemerolehan pertahanan seperti jurnal-jurnal dan penerbitan "yang memberitahu anda tentang maklumat itu."

"Jika anda membeli peluru, banyak pakar boleh memberitahu anda mengapa. Jadi tiada apa yang perlu disembunyikan.

Jika anda cari di Google, anda akan menemui apa yang kerajaan Malaysia ada. "Dasar pemerolehan perlu dibuat dengan jelas. Budaya rahsia ini perlu dihentikan," katanya.

Khairy: Yes to transparency, but not for arms buys

KUALA LUMPUR, July 30 — Umno Youth chief Khairy Jamaluddin has declared support for a Freedom of Information (FOI) Act, but stressed last night that several areas needed to be excluded in the interest of national security, such as defence procurements.

He pointed out that "no country will disclose specifications" of their military hardware due to security concerns.

"The exact specs of tanks, what kind of systems and missiles we use shouldn't be discussed in Parliament and recorded down on the Hansard," the Rembau MP said at a forum on FOI at the Bar Council last night.

The issue of defence deals cropped up again after authorities deported a French lawyer who has been pursuing judicial investigations intoMalaysia's controversial RM7 billion Scorpene submarine purchase in the French courts, the day after he spoke on the issue inPenang.

In his absence, Pakatan Rakyat (PR) MPs had accused the Najib administration of wanting to keep the facts hidden in the purchase of the submarines from French defence firm DCNS and up to RM16 billion in defence deals over the past three years.

However, Khairy, along with DAP lawmaker Charles Santiago, mooted an Armed Services committee instead be formed by lawmakers and the armed forces to hear representations from field experts before discussing policy in secret.

When asked if this would still mean that decision-making was shrouded in secrecy, he said that "some disclosure is better than none and at least MPs, representatives of the people, will have the information."

The purchase of two submarines from French defence company DCNS in 2002 was made when Datuk Seri Najib Razak was still defence minister and a company run by Abdul Razak Baginda, said to be a close aide of the then-deputy prime minister, was reported to have received commissions of over RM500 million from the deal.

Human rights groups and opposition parties here also linked the episode to the 2006 murder of Mongolian Altantuya Shaariibuu.

In December 2009, Suaram filed a complaint with the French courts asking for access to information regarding government contracts signed with Abdul Razak's Perimekar Sdn Bhd and other information classified as official secrets inMalaysia.

The French courts accepted the request to investigate claims of graft in the RM500 million payment from DCNS to Perimekar.

French lawyer William Bourdon had arrived inKuala Lumpuron July 23 fromPenang, where he spoke at a fundraiser organised by rights group Suaram regarding the Scorpene submarine deal but was prevented from speaking at further events when immigration officers boarded his plane and detained him before deporting him the same night.

Klang MP Santiago had said thatMalaysiashould go further than simply forming a committee to scrutinise defence procurement as defence journals and publications "already tells you who's buying what for how much."

"If you buy a missile for so much, experts can tell you why. So there is nothing to hide. If you search on Google, you can find out what the Malaysian government has.

"Procurement policies should be made clearer. This culture of secrecy must come to an end”, he said.
